Home Purchase Agreements: What Are They Contingent On?

As a real estate enthusiast, I have always been fascinated by the intricate details of home purchase agreements. It is amazing how these legal documents can shape the entire process of buying a home. One of the most interesting aspects of these agreements is the contingencies that are often included. In this blog post, we will explore what home purchase agreements are contingent on and why these contingencies are important.

Contingent Financing

One of the most common contingencies in a home purchase agreement is the financing contingency. This contingency protects the buyer in case they are unable to secure a mortgage to finance the purchase of the home. According to the National Association of Realtors, 77% of homebuyers in 2020 financed their home purchase. This shows just how crucial it is for buyers to have a financing contingency in place.

Year Percentage Homebuyers who Financed Their Purchase
2020 77%
2019 78%
2018 77%

It is important for buyers to be able to secure financing before committing to the purchase of a home. Without this contingency, they could be at risk of losing their earnest money deposit if they are unable to obtain a loan.

Contingent on Home Inspection

Another crucial contingency in a home purchase agreement is the home inspection contingency. This contingency allows the buyer to have a professional inspection of the home to identify any potential issues or defects. In 2020, 86% of homebuyers obtained a home inspection before making their purchase, according to the American Society of Home Inspectors.

Year Percentage Homebuyers who Obtained a Home Inspection
2020 86%
2019 85%
2018 84%

By including a home inspection contingency, the buyer has the opportunity to negotiate repairs or request a price reduction if any issues are found. This can ultimately save them from purchasing a home with significant problems.

Home purchase agreements are contingent on a variety of factors, but the financing and home inspection contingencies are among the most essential. These contingencies provide protection for the buyer and ensure that they are making a well-informed decision when purchasing a home. As someone who is deeply passionate about real estate, I find it fascinating how these contingencies can significantly impact the outcome of a home purchase. Understanding the importance of these contingencies is crucial for both buyers and sellers in the real estate market.

Home Purchase Agreement Contingencies

When entering into a home purchase agreement, there are certain contingencies that must be met in order for the contract to be valid. This legal contract outlines the two items that home purchase agreements are contingent on.

Clause 1: Financing Contingency

Buyer`s obligation to purchase the Property is contingent upon Buyer obtaining a written commitment for financing the purchase of the Property from a lender at prevailing market rates for the period of any interest rate lock described below. Buyer shall apply for such financing within the time period specified below (“Financing Contingency Deadline”). If, despite reasonable efforts by Buyer, Buyer is unable to obtain a written commitment for such financing within the Financing Contingency Deadline, then Buyer may terminate this Contract by delivering written notice to Seller within the Financing Contingency Deadline stating that Buyer`s financing application has been denied. If Buyer does not terminate this Contract as provided in this Paragraph, then Buyer shall be deemed to have waived Buyer`s right to terminate this Contract due to the financing contingency. If Buyer timely terminates this Contract as provided in this Paragraph, then the Earnest Money shall be refunded to Buyer, and neither party shall have any further rights or obligations under this Contract.

Clause 2: Inspection Contingency

Buyer`s obligation to purchase the Property is contingent upon Buyer`s satisfactory completion of a home inspection within a specified period of time. Buyer shall have the right to have the Property inspected by a licensed home inspector, and the inspection shall be completed at Buyer`s expense. If the inspection reveals any material defects or issues with the Property, Buyer may terminate this Contract by delivering written notice to Seller within the inspection contingency period. If Buyer does not terminate this Contract as provided in this Paragraph, then Buyer shall be deemed to have waived Buyer`s right to terminate this Contract due to the inspection contingency. If Buyer timely terminates this Contract as provided in this Paragraph, then the Earnest Money shall be refunded to Buyer, and neither party shall have any further rights or obligations under this Contract.
